Irene Miller was arrested last Friday on four counts of child neglect without bodily harm after leaving her four children home alone in Kissimmee for several days. The incident gained national attention after online users debated the adequacy of her supervision. Miller, 50, told investigators she was in Las Vegas for work.
The investigation began on October 21 when one of the children called 911. The caller reported that her nine-year-old brother was hurt after a dumbbell fell on his head. Osceola County Sheriff’s Office deputies arrived at the home and found no adults present. The children, aged 14, 12, 11, and 9, were left unsupervised during Miller’s absence.
Deputies contacted Miller, who said she had left for Las Vegas on October 18 and planned to return on October 23. She explained that she had arranged for a babysitter from Tampa to help the children get ready for school in the mornings and check on them after school. The sitter was not required to stay overnight, according to investigators.
Richard Hornsby, an Orlando defense attorney who is not involved in the case, noted that no law explicitly bans leaving children unsupervised. He stated that legal issues arise when children are left alone for prolonged periods. Hornsby said courts examine whether a parent took reasonable measures and acted as a prudent person would in the same situation. He added that details about a pending domestic violence case against the children’s father provided additional context to the circumstances.
County court records show Miller filed for divorce in September. In August, her husband was charged with misdemeanor battery against her, resulting in a no-contact order. Sheriff Chris Blackmon said in a statement that the department does not tolerate child neglect. He confirmed that deputies contacted the children’s father, who took the children to his home.
The case is currently pending in Osceola County. Miller is scheduled to appear in court to address the four neglect charges. The sheriff’s office continues to review the details of the supervision arrangements provided during her trip.
